Definition of bribe-taking, abuse of official position, and misappropriation concepts

Acceptance of a bribe (Article 368 of the Criminal Code of Ukraine). Acceptance of a bribe by a public officer for fulfillment or non-fulfillment of requirements of a briber, or in the interests of the third parties, with the use of the official position, shall inflict a fine, ranging from five hundred to seven hundred exemption limits for citizens' income, or correctional labor for a term of up to one year, or arrest for a term of up to six months, with deprivation of the right to hold certain positions for a term of up to three years.
Acceptance of a large-scale bribe by a person, holding a certain official position, or in premeditated collision by a group of persons, shall inflict deprivation of liberty for a term from five to twelve years, with deprivation of the right to hold certain positions or to carry out certain activities for a term of up to three years with confiscation of property.
Note. A grand bribe is a bribe exceeding the exemption limit of citizens' income by two hundred or more times; a large-scale bribe is a bribe exceeding the exemption limit of citizens' income by five hundred or more times.
 
Offer of a bribe or act of bribing (Article 369 of the Criminal Code of Ukraine). Offer of a bribe shall inflict a fine, ranging from one hundred to two hundred fifty exemption limits for citizens' income or restraint of liberty for a term of up to two years.
Any act of bribing shall inflict a fine, ranging from two hundred fifty to seven hundred fifty exemption limits for citizens' income or restraint of liberty for a term from two to five years. Any act of bribing of a public officer shall inflict deprivation of liberty for a term from four to eight years with confiscation of property or without it.
Any person, offering a bribe or bribing, shall be exempted from criminal liability, if any extortion of a bribe has taken place, or if after the act of bribing such person has voluntarily informed about such act.
 
Abuse of official position (Article 364 of the Criminal Code of Ukraine) is a deliberate, out of lucrative motives or in any other personal interests, use, by a public officer, of his/her authority or official position contrary to the interests of their service, if such use has inflicted a damage to the legally protected rights, freedoms, and interests of individual citizens or state or public interests, or interests of legal entities, and shall correctional labor for a term of up to two years, or arrest for a term of up to six months, or restraint of liberty for a term of up to three years, with deprivation of the right to hold certain positions or to carry out certain activities for a term of up to three years. This same act, if it has entailed grave consequences, shall inflict deprivation of liberty for a term from five to eight years, with deprivation of the right to hold certain positions or to carry out certain activities for a term of up to three years.
 
Misappropriation (Article 185 of the Criminal Code of Ukraine) is an unlawful and unpaid seizure and/or use of somebody else's property, committed for mercenary ends in favor of the guilty person or any other persons, inflicting losses to the owner of this property. There are different kinds of misappropriation: larceny, fraud, theft, appropriation, embezzlement, and others – all of them, depending on the scale of the misappropriation, shall inflict a fine, public works or correctional labor, or deprivation of liberty for a term from three to twelve years.
